1. INTRODUCTION & ACCEPTANCE

These Terms and Conditions (“Terms”) govern your use of the AGRO Export Hub website at www.agroexportshub.com and any business or export transactions entered into with AGRO Export Hub (“we”, “us”, “our”, “the Company”).

By accessing this website, submitting an inquiry, requesting a quote, or placing an order with AGRO Export Hub, you (“the Buyer”, “you”, “your”) agree to be bound by these Terms in full. If you do not agree with any part of these Terms, please do not use this website or proceed with any business transaction with us.

These Terms apply to all visitors, buyers, importers, distributors, food manufacturers, and any other party who engages with AGRO Export Hub through this website or through direct business communication.

2. PRODUCTS & PRODUCT INFORMATION

AGRO Export Hub exports the following products:

  • Bold Peanuts (Runner Variety) — HS Code 12024210

All product descriptions, specifications, nutritional values, and quality parameters published on this website are provided in good faith and are based on standard export grades and typical batch results. Actual specifications for any given shipment will be confirmed in writing at the time of order confirmation and may vary slightly by crop season, harvest region, and agreed buyer specifications.

Product images on this website are representative only. The appearance of actual goods may differ slightly due to natural agricultural variation in colour, size, and skin tone across crop seasons.

All prices, if quoted on this website, are indicative only and subject to change based on market conditions, crop season, and order volume. Final pricing is confirmed only through a formal written quotation issued by our export desk.


3. INQUIRIES & QUOTATIONS

Submitting an inquiry or quote request through our website does not constitute a binding order or contract. An inquiry is simply an expression of interest and initiates a conversation with our export desk.

Upon receiving your inquiry, we will respond with a formal quotation that includes product specifications, pricing, Incoterms, payment terms, and estimated lead time. A contract is formed only when:

  • You have received and reviewed our formal written quotation.
  • You have issued a written purchase order or confirmed acceptance of the quotation in writing (email is acceptable).
  • We have confirmed acceptance of your purchase order in writing.

AGRO Export Hub reserves the right to decline any inquiry or order at its sole discretion without being required to provide a reason.


4. PRICING & PAYMENT

All prices are quoted in US Dollars (USD) unless otherwise agreed in writing. Prices are subject to change prior to order confirmation based on fluctuations in market rates, foreign exchange, freight costs, and seasonal availability.

Payment terms will be specified in the formal quotation and may include:

  • Advance payment (T/T — Telegraphic Transfer) of an agreed percentage prior to shipment.
  • Balance payment via T/T against shipping documents or Bill of Lading copy.
  • Letter of Credit (LC) at sight from an internationally recognised bank, subject to prior agreement.
  • Other payment arrangements as mutually agreed in writing.

All bank charges, transfer fees, and LC charges outside India are to be borne by the Buyer. Payments must be received in full and funds cleared before shipment is released unless otherwise agreed in writing.

AGRO Export Hub reserves the right to suspend or cancel an order if payment is not received within the agreed timeline.


5. ORDERS & ORDER CONFIRMATION

The minimum order quantity (MOQ) is one 20-foot container (approximately 18–19 metric tons), unless otherwise agreed in writing for specific circumstances.

Upon receipt of your confirmed purchase order and applicable advance payment, we will issue a formal Order Confirmation outlining:

  • Product name, variety, and count/grade
  • Quantity and packaging specifications
  • Agreed quality parameters
  • Shipment timeline and port of loading
  • Payment schedule

Any changes to a confirmed order must be requested in writing and are subject to our written acceptance. Changes requested after production or packing has commenced may not be possible and may attract additional charges.


6. QUALITY & SPECIFICATIONS

We are committed to delivering peanuts that match the agreed specifications. Our standard quality parameters are:

  • Moisture content: 6% to 8%
  • Broken kernels: maximum 2%
  • Foreign matter / admixture: below 1%
  • Aflatoxin B1: maximum 2 ppb
  • Total aflatoxins (B1+B2+G1+G2): maximum 4 ppb
  • Free Fatty Acids (FFA): maximum 1%
  • Peroxide value: maximum 5 meq O₂/kg oil

Pre-shipment samples will be provided upon request prior to order confirmation. Bulk shipments are processed to match approved samples using the same grade, settings, and batch logic.

Pre-shipment inspection by a third-party agency (SGS, Eurofins, or equivalent) can be arranged at the Buyer’s request. The cost of third-party inspection is to be borne by the Buyer unless otherwise agreed.

Once goods have been loaded and the Bill of Lading has been issued, AGRO Export Hub’s quality responsibility is fulfilled subject to the agreed Incoterms. Any quality claims must be raised within 14 days of arrival of goods at the destination port, supported by a survey report from a recognised independent inspection agency.


7. PACKAGING

Standard packaging options include:

  • 20 kg, 25 kg, or 50 kg bags
  • Bag material: HDPE, PP (Polypropylene), Vacuum-sealed, or Jute bags
  • Loading capacity: approximately 18 MT per 20-foot container, 26 MT per 40-foot container

Custom packaging, labelling, or private labelling requirements must be specified at the time of inquiry and confirmed in the purchase order. Additional charges may apply for non-standard packaging. AGRO Export Hub will not be held responsible for packaging-related issues arising from instructions provided by the Buyer.


8. SHIPMENT & DELIVERY

Unless otherwise agreed, all shipments are made on FOB (Free On Board) basis from the port of loading in India. Other Incoterms (CFR, CIF, etc.) can be arranged and will be specified in the formal quotation.

Estimated lead time from order confirmation to shipment is typically 15 to 25 working days, depending on product availability, packaging requirements, and documentation processing. Lead times are estimates only and AGRO Export Hub shall not be held liable for delays caused by factors outside our reasonable control, including port congestion, vessel scheduling, government inspections, or force majeure events.

Shipping documents, including the Bill of Lading, Commercial Invoice, Packing List, Certificate of Origin, Phytosanitary Certificate, and any other required documents, will be prepared and dispatched as agreed in the purchase order. It is the Buyer’s responsibility to ensure they have the correct import permits, licenses, and approvals required by their country of import.


9. TITLE & RISK

Title to and risk of loss of the goods passes to the Buyer in accordance with the agreed Incoterms specified in the order confirmation. Under standard FOB terms, risk passes to the Buyer once the goods are loaded on board the vessel at the port of loading in India.

AGRO Export Hub is not responsible for loss, damage, deterioration, or delay occurring after risk has passed to the Buyer.


10. CLAIMS & DISPUTES

Any claims relating to quality, quantity, or condition of goods must be:

  • Raised in writing to contact@agroexportshub.com within 14 days of the arrival of goods at the destination port.
  • Supported by a survey or inspection report issued by a recognised independent third-party inspection agency.
  • Accompanied by photographic evidence and relevant shipping documents.

Claims will not be considered if goods have been further processed, blended, re-packed, or altered by the Buyer or any third party prior to the claim being raised.

AGRO Export Hub’s maximum liability in respect of any claim shall not exceed the invoice value of the specific goods to which the claim relates. We shall not be liable for any indirect, consequential, or special losses, including loss of profit, loss of business, or production downtime.


11. FORCE MAJEURE

AGRO Export Hub shall not be held liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters, floods, droughts, or crop failures
  • Government actions, export restrictions, or regulatory changes
  • Port closures, strikes, or industrial action
  • Pandemic, epidemic, or public health emergencies
  • War, civil unrest, or geopolitical disruption
  • Power outages or infrastructure failures

In the event of a force majeure situation, we will notify the Buyer as soon as reasonably practicable and make best efforts to resume performance or arrange an alternative solution.


12. INTELLECTUAL PROPERTY

All content on this website, including text, product descriptions, images, logos, graphics, and design elements, is the property of AGRO Export Hub or is used with permission and is protected by applicable intellectual property laws.

You may not reproduce, copy, republish, distribute, or use any content from this website for commercial purposes without our prior written consent. You may share links to our website or reference our publicly published specifications for legitimate business evaluation purposes.


13. WEBSITE USE

You agree to use this website only for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit their use and enjoyment of the site. You must not:

15. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, AGRO Export Hub shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of this website or any transaction conducted with us, even if we have been advised of the possibility of such damages.

Our total liability in connection with any transaction shall not exceed the invoice value of the goods supplied under that specific order.

Nothing in these Terms limits our liability for fraud, gross negligence, or any other liability that cannot be excluded by law.


16. GOVERNING LAW & JURISDICTION

These Terms and any disputes arising out of or in connection with them, including disputes relating to export transactions, shall be governed by and construed in accordance with the laws of India.

Any disputes that cannot be resolved amicably between the parties shall be subject to the exclusive jurisdiction of the courts of Jhansi, Uttar Pradesh, India, unless otherwise agreed in a separate written contract between the parties.

For international buyers, we are open to mutually agreed arbitration under the rules of a recognised arbitration body as an alternative to court proceedings. Any such arrangement must be agreed in writing prior to a dispute arising.


17. AMENDMENTS

AGRO Export Hub reserves the right to amend, update, or replace these Terms at any time. The updated Terms will be published on this website with a revised “Last Updated” date. Your continued use of the website or engagement in business with us after any changes constitutes your acceptance of the updated Terms.

For active buyers and importers, we recommend reviewing these Terms periodically. Material changes that affect ongoing business relationships will be communicated directly by email where reasonably practicable.


18. SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be severed from the remaining Terms, which shall continue in full force and effect.


19. ENTIRE AGREEMENT

These Terms, together with any formal quotation, order confirmation, and the Privacy Policy published on this website, constitute the entire agreement between AGRO Export Hub and the Buyer with respect to the subject matter herein and supersede all prior discussions, representations, or agreements, whether written or oral.
